ADVICE FOR THE LAND AND ENVIRONMENT COURT

Researching

You have a very complex task but one that, if you work through it logically, will be straightforward in the long run. Take the steps one by one and it will make good sense.

Preparing

Do not think like students. Think like adults. You must forget any favouratism you might have with fellow students in different groups. You might even feel that you would rather be in the Student Group or one of the other groups yourself. However, one of the reasons you are in this group is because your teacher believes that you can go beyond those ideas and remove yourself from your feelings. Only then will you be able to come to a sensible conclusion BASED ON THE SUBMISSIONS MADE BY THE OTHER GROUPS. You must not go into the court hearing with any preconceived ideas. You may only make your decision on what you hear and read from their submissions but with the knowledge and experience of other decisions made by the court in the past. Research those past experiences through the special links on the Resources page.

Listening

Go into the Court hearing with prepared paperwork. You should have a copy of each of the submissions. You must have read the submissions BEFORE the court case. You should make comments on the submissions of any questions you wqnt to ask seeking clarification. You should know what their arguments are BEFORE you go in. During the hearing make sure that you take additional notes if necessary and listen to the emphasis the petitioner makes in their submission. It may be different to the way you have read the submission.

Submission

You will need to prepare a report for written submission from the Court detailing your judgement and for assessment. You will need to have a copy for your teacher and a copy for each of the groups at the time you present your decision. Have a look at one guideline as to how to prepare a general report here. This advice might be too detailed for you but use it as a guideline. Your teacher will also tell you whether you need to include things such as bibliographies and footnoting.
